Usage Policy for SustainableX

This Usage Policy (“Policy”) governs the acceptable use of the SustainableX platform (“Platform”), a venture of Bhavi Ventures Private Limited. By accessing, using, or subscribing to any of the services provided by SustainableX (“we,” “our,” or “us”), you (“user,” “you,” or “your”) agree to comply with the terms outlined in this Policy. SustainableX provides Environmental, Social, and Governance (ESG) solutions, including reporting, auditing, and analytics services through its Platform. Our goal is to ensure a secure, compliant, and ethical environment for all users.

1. Scope of the Policy

This Policy applies to all users, including businesses, employees, contractors, partners, and any entity authorized to access or use the Platform. It is designed to prevent misuse, protect the integrity of our services, and ensure that all users engage with the Platform responsibly.

The Policy applies to:

Use of the SustainableX platform, services, applications, APIs, and any websites under our control.
Interaction with other users and third parties via the Platform.
Uploading, transmitting, or storing any content on the Platform.

2. Acceptable Use of the Platform

The SustainableX Platform is intended for lawful business use, focusing on ESG reporting, audits, and related activities. Users are expected to:

Comply with Applicable Laws: All activities on the Platform must comply with local, state, national, and international laws and regulations. This includes laws governing data protection, intellectual property, and privacy.
Use in Accordance with Platform Objectives: The Platform is designed to support users in their ESG and sustainability reporting, audits, and compliance activities. The Platform must not be used for purposes unrelated to these objectives.
Access: Users are responsible for securing their credentials (usernames, passwords, API keys, etc.) and are prohibited from sharing these with unauthorized persons.
Respect for Privacy: Users must not engage in activities that violate the privacy or confidentiality of other users, including unauthorized data access, exposure of personally identifiable information (PII), or attempts to exploit vulnerabilities.

3. Prohibited Activities

Users are prohibited from engaging in the following activities:

Illegal Activities: Engaging in or promoting any unlawful activity, including fraud, hacking, identity theft, or cybercrime.
Unauthorized Access: Attempting to gain unauthorized access to any portion of the Platform or circumventing any security measures.
Misuse of Data: Harvesting, scraping, or using any automated means to access user data without permission. Users are not allowed to mine, scrape, or extract data from the Platform for commercial purposes without explicit authorization from SustainableX.
Malware and Viruses: Introducing viruses, malware, or other harmful code that could disrupt, damage, or interfere with the Platform’s operation or other users’ access.
Spamming and Phishing: Engaging in unsolicited messaging, spamming, or phishing activities directed at other users, or using the Platform for advertising without prior consent.
Content Restrictions: Uploading or transmitting offensive, inappropriate, or illegal content, including but not limited to content that is obscene, defamatory, harassing, harmful, or promotes hate speech.
Infringement of Intellectual Property: Violating any intellectual property rights, including copyright, trademark, patent, or other proprietary rights of SustainableX or third parties.
Reverse Engineering: Attempting to reverse-engineer, decompile, or otherwise derive source code from the Platform or any associated software.

4. Content and Data Usage

Users are responsible for the content they upload, share, or transmit via the Platform. By using the Platform, users agree to the following terms regarding content:

Ownership of Data: Users retain ownership of all data they upload. However, by uploading data, users grant SustainableX the right to process, analyze, and store the data for the purpose of providing Platform services, including analytics and reporting.
Data Accuracy: Users must ensure that the data provided on the Platform is accurate, up-to-date, and not misleading. Users are responsible for any misrepresentation of data in their ESG reports or other documentation.
Content Restrictions: Users must not upload any illegal or prohibited content, including but not limited to pirated materials, unauthorized copies of copyrighted works, or materials promoting illegal activities.
Third-Party Content: Users must ensure that any third-party content they upload complies with applicable laws and regulations and does not infringe on the intellectual property or privacy rights of others.

5. Data Privacy and Security

SustainableX is committed to protecting the privacy and security of user data. Users agree to the following:

Personal Data: Users must adhere to applicable data protection regulations, including but not limited to the General Data Protection Regulation (GDPR), California Consumer Privacy Act (CCPA), and other relevant laws, when handling personal data via the Platform.
Security Measures: Users must implement adequate security measures, such as strong passwords and multifactor authentication, to protect their accounts and the data they access via the Platform.
Data Storage: Users should not upload or store sensitive data, such as personal health information (PHI), financial account numbers, or any other data requiring specific regulatory protection (e.g., HIPAA, PCI DSS), unless explicitly agreed upon with SustainableX.
Incident Reporting: Users must immediately notify SustainableX of any security incidents, data breaches, or unauthorized access to their accounts or data. Reports should be submitted to info@sustainablex.in.

6. API and Third-Party Integrations

Users may access the Platform via our Application Programming Interfaces (APIs) or integrate third-party applications. When using APIs or integrating third-party systems, the following conditions apply:

API Usage: Users must use SustainableX’s APIs in compliance with our API documentation and not exceed rate limits or quotas imposed on API calls.
Third-Party Services: If a user integrates third-party services with the Platform, SustainableX is not responsible for any data sharing or processing performed by such services. Users are encouraged to review and adhere to the terms of service and privacy policies of any third-party providers they use.
Data Sharing with Third Parties: Any sharing of data with third-party services or vendors must comply with applicable data privacy laws. Users are responsible for ensuring that third-party services meet the necessary compliance standards.

7. Fair Usage

To ensure equitable access to the Platform for all users, SustainableX reserves the right to impose limits on data storage, API usage, or other resources. Users exceeding these limits may be subject to additional charges or restrictions.

8. Termination and Suspension

SustainableX reserves the right to suspend or terminate user accounts that violate this Policy. In cases of egregious or repeated violations, we may:

Disable access to the Platform or specific features.
Terminate user accounts without prior notice.
Take legal action or report unlawful activity to the authorities.

9. Changes to This Policy

SustainableX reserves the right to update or modify this Usage Policy at any time. Any changes will become effective immediately upon posting the updated Policy on the Platform. Continued use of the Platform after changes are posted constitutes acceptance of the revised Policy.
